A de facto relationship is broadly defined as a relationship between two people, including same sex couples, who have lived together in a marriage-like relationship.

Recent legislative amendments to the Family Court Act provide all de facto couples similar rights to married couples. These are enforceable through the Family Court of Western Australia.
Parties who separate from a de facto relationship, regardless of the date of separation, are able to access the Family Court of Western Australia for children's matters.

CMS Legal can provide expert family law advice on how de facto separation affects property and asset division as well as children’s matters. We can help you with court proceedings and provide guidance on how to effectively reach an agreement.
